Businesses with fewer than 50 full-time equivalent employees (FTEs) are generally not required to offer health insurance under the ACA, but many choose to in order to attract and retain talent. Once you reach 50+ FTEs, you may be considered an Applicable Large Employer (ALE) and may have ACA employer mandate and reporting obligations; penalties can apply in certain situations if coverage is not offered or does not meet affordability/minimum value standards. Some states have additional requirements (for example, Hawaii’s Prepaid Health Care law).
